For over 100 years (1913) the Historic Monuments Law has incited and encouraged renovation and upkeep of our architectural heritage listed in the Supplementary Inventory of Historic Monuments (ISMH). Under certain conditions, it allows for tax benefits for restoration, renovation, maintenance, and enhancement of our listed buildings. The work undertaken must be inspected and followed by the “Architectes des Bâtiments de France”. If the building is open to the public at least 40 to 50 days per year, the work is deductible up to your marginal tax bracket with no limitation, i.e., a tax reduction of 45% for the highest tax bracket. On the other hand, if the building is not open to the public, a limit on deductibility for the work is fixed at 200,000 € per year. If the amount required to carry out the work is higher, invoicing of this cost must be spread over two years or more. Finally, this law enables you to benefit from exoneration from inheritance and donation taxes by signing, under conditions, an agreement validated by the Ministry of Culture.
While the HM Law concerns any property registered with the ISMH, whether a building on the Île de la Cité in Paris or a château in the midst of the forest of Brocéliande, the Malraux Law concerns, for its part, all buildings that exist within a well-defined, protected sector. Most of France’s historic towns have a protected sector. Paris has two of them, the 7th arrondissement and Le Marais, as far as the Saint Paul neighbourhood.
The amount of restoration, renovation, maintenance and enhancement work carried out and inspected by the “Architectes des Bâtiments de France” (ABF) will enjoy a tax reduction of between 22% and 30% up to a ceiling of 400,000 € over a period of 4 years commencing in the year when the “Autorisation Spécial de Travaux” (AST – special authorization for work) is obtained.
