Rental investment all about Loc'avantages

The Loc’Avantages system offers a comfortable tax reduction to investors who agree to rent to low-income tenants for an affordable rent.

Successor to the old Cosse scheme since March 2022, the Loc’Avantages scheme offers a comfortable tax reduction to investors who agree to rent to low-income tenants for an affordable rent. The terms of application of this new system have just been adopted by the public authorities.

A more generous tax benefit 
Since 2017, owners of housing located in tight areas could rent it out as part of the Cosse system, also called Affordable Rent. They had to conclude an agreement with the National Housing Agency (Anah). They agreed to rent for at least 6 years to a tenant with limited resources, for a rent below the market price. In return, they benefited from a flat-rate deduction chargeable to their taxable rents, the rate of which was between 15 and 85% depending on the location of the accommodation and the efforts made on the rent (rental in an intermediate, social or very social sector).
The 2022 Finance Law transformed the deduction attached to this scheme into a tax reduction, and renamed the "Loc'Avantages" scheme, for agreements signed with Anah since March 1, 2022. investor remain the same, but he now benefits from a tax reduction calculated on the rents collected throughout the duration of the lease, identical regardless of the geographical location of his property.

Its rate is set at 15% in the case of rental in the intermediate sector and at 35% in the case of rental in the social sector. In the event of recourse to an organization approved by the State which is responsible for rental management (formula known as rental intermediation), the reduction is increased to 20% in the intermediate sector, to 40% in the social sector, and it reaches 65 % in case of rental in very social sector.

Good to know: thanks to this development, the public authorities hope to encourage more investors to rent to modest tenants. With the tax reduction, all landlords can now reduce their taxes in the same proportions, whereas the previously applicable deduction provided them with variable savings depending on their tax rate. In some cases, renting with Loc’Avantages can even turn out to be more profitable than renting at the market price without tax advantages.

Rent ceilings set locally

The rent ceiling to be respected by the lessor during the period covered by his rental commitment in Loc'Avantages is not fixed at the national level, but according to an estimate of the market rents applicable in each municipality or, for Paris , Lyon and Marseille, in each arrondissement. The estimate of the market rent is then subject to a discount of 15% in the case of rental in the intermediate sector, 30% in the social sector and 45% in the very social sector.

Finally, the rent ceiling thus fixed is affected by a multiplier coefficient. This depends on the size of the accommodation. This coefficient makes it possible to rent more expensive the small residences and less expensive the large residences.
Loc’Avantages is the first tax-exempt rental system to set rent ceilings at the local level, and not at the national level. By way of derogation from the rules governing rents applicable in tight areas in the event of a change or renewal of the lease, the owner of the accommodation may, at the end of the agreement signed with Anah, freely set the rent for the re-letting of his property.
Tenant resource caps at three levels
Like the old Cosse, Loc’Avantages obliges the lessor to choose a tenant whose resources do not exceed a ceiling, which varies according to the composition of their household, the location of the accommodation and the rental sector chosen (intermediate, social or very social). This ceiling must be respected at the conclusion of the initial lease and at each change of tenant. On the other hand, during the lease, the resources of the tenant in place can increase without this calling into question the application of the system.
An online simulator on the Anah website makes it possible to quickly calculate the tenant's resource ceiling (and rent) to be respected depending on the location of the property to be rented and the rental sector chosen. It also allows you to calculate the amount of the tax reduction to which you can claim, this being all the higher as the rent is reduced. Note: The most energy-intensive homes, classes F and G of the DPE (Energy Performance Diagnosis), are excluded from the Loc’Avantages scheme. For leases entered into or renewed from 2028, E-rated accommodation will also be excluded.
