Sale on a "viager" basis is a contract in which the rights and obligations of both parties are limited to the lifetime of the seller, referred to in the contract as the "crédirentier" or "annuity recipient". The buyer, known as the "débirentier", pays part of the sale price in the form of a "bouquet" or down payment, and the rest in the form of a fixed life annuity paid periodically for the duration of the seller's lifetime.
Advantages of the "viager"
For the seller, this is a way of ensuring additional income for the rest of his/her life, boosting a pension while retaining, or not, the use of the property thus sold. For the buyer, an investment "en viager" is a way of acquiring real estate assets at a reduced price and with tax advantages.
Occupied "viager"
The seller retains the exclusive right to use and occupy the property, receiving a down payment followed by further instalments to the end of his days.
Bare ownership - Dismemberment
The seller retains the right to occupy the property and receives a cash payment for the full value of the property in bare ownership, taking his/her age into account.
Unoccupied "viager"
The buyer can occupy or rent out the property. The seller receives a higher down payment followed by higher instalments for the rest of his/her life.
Forward sale
The seller can determine the duration of the payments and the duration of his/her occupancy. The monthly payments are not taxable.
Usufruct or right of use and occupancy
The seller has the possibility of either retaining the right to use and occupy the property throughout his/ her lifetime, a strictly personal right limited solely to living in the accommodation (but not renting it out), or opting for usufruct: he/she can then personally use the property sold, but also receive rental income in addition to life annuity payments.
